Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Rainmaker platform, operated by ArcheMatch Inc. ("Company," "we," "us," or "our"), accessible at rainmakerapp.io and archematch.com. By accessing or using Rainmaker, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our platform, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy. If you are using Rainmaker on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Rainmaker is an AI-powered psychological intelligence platform that helps financial professionals identify, research, and connect with prospective clients. The platform uses Jungian personality frameworks, public data analysis, and AI-driven research to generate compatibility assessments and personalized outreach recommendations.

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, all activity under your account, and ensuring that your use of Rainmaker complies with all applicable laws and industry regulations, including FINRA and SEC guidelines where applicable. You agree not to share your account with unauthorized users or use the platform for any unlawful purpose.

4. Acceptable Use

You agree not to: (a) use Rainmaker to send unsolicited bulk communications in violation of CAN-SPAM or similar laws; (b) misrepresent your identity or affiliation; (c) attempt to reverse-engineer, decompile, or extract our proprietary algorithms; (d) scrape, harvest, or systematically collect data from the platform; (e) use the platform to harass, stalk, or intimidate any individual; or (f) resell, sublicense, or redistribute access to Rainmaker without our written consent.

5. Intellectual Property

All content, algorithms, designs, and technology within Rainmaker are the exclusive property of ArcheMatch Inc. Our psychological matching algorithms, compatibility scoring methodology, and archetype inference system are protected by 132 patent claims filed with the United States Patent and Trademark Office. You retain ownership of any data you provide to the platform, subject to the licenses granted in these Terms and our Privacy Policy.

6. Third-Party Services

Rainmaker integrates with third-party services including LinkedIn, Perplexity AI, and other data providers. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

7. Disclaimers

Rainmaker is provided "as is" and "as available." We make no warranties, express or implied, regarding the platform's reliability, accuracy, or fitness for a particular purpose. Rainmaker does not provide financial, legal, or investment advice. Psychological profiles and compatibility scores are generated by AI and should be used as one input among many in your professional decision-making.

8. Limitation of Liability

To the maximum extent permitted by law, ArcheMatch Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Rainmaker. Our total liability for any claims relating to the service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Subscription and Payment

Paid features are billed on a monthly or annual basis as selected at the time of purchase. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the platform ceases immediately, and you may request deletion of your data per our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Eagle County, Colorado.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 30 days before taking effect. Continued use of Rainmaker after changes constitutes acceptance of the updated Terms.
